ORDINANCE 2026-4
AN ORDINANCE OPTING OUT OF THE OKLAHOMA TOWN MEETING ACT: REQUIRING ELECTIONS AND INITIATIVE AND REFERENDUM QUESTIONS TO BE DECIDED ONLY THROUGH ELECTIONS CONDUCTED BY THE COUNTY ELECTION BOARD; PROVIDING AN EFFECTIVE DATE; AND ESTABLISHING AN AUTOMATIC REPEAL DATE.
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF CAMARGO, OKLAHOMA:
Section 1. Pursuant to 11 O.S. Section 16-302, the Town of Camargo hereby declares that it shall not be governed by the Oklahoma Town Meeting Act as a means of deciding initiative and referendum questions for the June 16, 2026, OG&E Franchise election. The Town of Camargo hereby declares initiative and referendum questions shall be conducted by the Dewey County Election Board, but only with respect to the June 16, 2026, OG&E Franchise Election, pursuant to Title ll. Section 16-101 et. seq. of the Oklahoma Statutes.
Section 2. EFFECTIVE DATE. The effective date of this Ordinance shall be the March 25, 2026.
Section 3. SUNSET AND REPEALER. All ordinances or parts thereof which are inconsistent with this ordinance are hereby repealed. This Ordinance shall stand repealed and of no further force or effect as of 12:01 a.m. on June 17, 2026, without further action of the Board of Trustees.
Section 4. SAVINGS CLAUSE. Nothing in this ordinance hereby adopted shall be construed to affect any suit or proceeding now pending in any court, or any rights acquired, or liability incurred nor any cause or causes of action accrued or existing, under any act or ordinance repealed hereby. Nor shall any right or remedy of any character be lost, impaired, or affected by this ordinance.
Section 5. SEVERABILITY. If any one or more of the sections, sentences, clauses or parts of this ordinance, chapter or section shall for any reason be held invalid, the invalidity of such section, clause or part shall not affect or prejudice in any way the applicability and validity of any other provision of this ordinance. It is hereby declared to be the intention of the Board of Trustees of the Town of Camargo that this section of the Town of Camargo Municipal Code would have been adopted had such unconstitutional, illegal, or invalid sentence, clause, section, or part thereof not been included herein.
Section 6. CODIFICATION. This ordinance shall be codified as a part of the Town of Camargo Municipal Code.
Section 7. EMERGENCY. WHEREAS, it being immediately necessary for the preservation of the peace, health, safety and public good of the Town of Camargo and the inhabitants thereof that the provisions of this Ordinance be put into full force and effect in order to provide for election with the county election board; By reason whereof, this Ordinance shall take effect and be in full force and effect after its passage, as provided by law.
